On July 3, 2019, a dispute arose in a graft case against former Nairobi Governor Evans Kidero, with his lawyer contesting the use of bank statements as evidence.
Lawyer James Orengo argued that the bank statements were not certified and therefore could not be used in court, citing the Evidence Act.
Prosecution counsel Joseph Riungu countered that the Director of Public Prosecutions had complied with the requirements of the Evidence Act regarding the identification and production of computer printouts.
The case against Mr. Kidero and eight others involves allegations of conspiring to commit fraud, resulting in the loss of Sh213,327,300 at the county government between January 16, 2014, and January 25, 2016.
Earlier in May, the High Court declined to stop the case, ruling that the charges were specific and that Mr. Kidero had not yet been convicted.
A ruling on the admissibility of the bank statements as evidence is expected on Thursday.
