On August 23rd, 2021, President Uhuru Kenyatta made a significant move in the Kenyan judicial system, suspending Hon Lady Justice Mary Muthoni Gitumbi from her position as a Judge of the Environment and Land Court.
The suspension was based on a recommendation from the Judicial Service Commission (JSC), which had reviewed various medical reports indicating Justice Gitumbi's inability to perform her duties due to mental incapacity, as stated in Article 168 (1) (a) of the Constitution.
According to a Gazette Notice, the JSC had considered the medical reports and concluded that Justice Gitumbi was unfit to continue serving in her position.
As a result, President Kenyatta formed a tribunal to investigate the matter and determine whether Justice Gitumbi should be removed from office.
The tribunal, chaired by Lady Justice Omondi Hellen Amolo, will comprise six members, including Justice Luka Kiprotich Kimaru, Lady Justice Linnet Ndolo, and Dr. Margaret Othieno Makonyengo.
The tribunal's mandate is to consider the petition for Justice Gitumbi's removal and submit a report to the President for action.
