Aviation Operator Barred from Selling Aircraft Pending Case Determination

On August 23, 2021, a Kenyan court issued a restraining order against Ocean Airlines, preventing the company from selling or transferring an aircraft it owns.

The order was issued by Justice David Majanja in response to a lawsuit filed by Jetways Airlines, which claims that Ocean Airlines is attempting to dispose of its assets, including the aircraft.

According to the court documents, the aircraft in question is a Fokker 50 with the registration number 5Y-FAD, which is currently secured at a hangar at the Wilson International Airport under the control and security of Jetways Airlines.

Justice Majanja ruled that any action by Ocean Airlines may undermine any recovery or execution efforts by Jetways Airlines and that it would be proper to preserve the aircraft in its current state pending the hearing and determination of the arbitral proceedings.

Jetways Airlines had also sought an order directing Ocean Airlines to provide security for the sum of USD 569,995.57 claimed by the applicant, pending the hearing and determination of the arbitral proceedings between the parties.
