On August 23, 2021, the High Court issued a restraining order against Police Boss Hillary Mutyambai, Kabete OCPD Francis Muthui, and Deputy OCS Benson Wambua, effectively ordering them to keep off the Law Society of Kenya (LSK) headquarters.
The order, delivered by High Court Judge Justice Antony Murima, was issued in response to a petition filed by LSK, seeking interim conservatory orders. The society, through Havi & Company Advocates, claimed infringement on its rights and fundamental freedoms, as well as those of its members.
The police were also ordered to refrain from interfering with the affairs and internal operations of the society. However, they will have unhindered access to the premises in the course of carrying out any lawful investigations or when circumstances reasonably require the restoration of law and order.
LSK President Nelson Havi had previously confronted two police officers at the headquarters on August 2, alleging that they had locked up the offices, preventing the council from having a meeting. On August 10, a group of police officers broke into LSK offices, days after a change of security guards.
