On August 20, 2021, the Court of Appeal upheld a High Court judgment that found the Building Bridges Initiative (BBI) process unconstitutional. This decision has sparked a call to action from Senator Cleophas Malala, who is urging the government to shift its focus towards the country's development agenda.

Speaking at Deliverance Church in Mumias, Malala emphasized the need for the government to accept the court verdict and plan how to address the country's pressing issues. He noted that the nullification of the BBI now presents an opportunity for the country to focus on fighting COVID-19 and other emerging challenges.

Malala also highlighted the need for the government to improve the country's healthcare system, which he believes has been overwhelmed by the COVID-19 pandemic. He suggested that public hospitals should offer free treatment for viral diseases, citing the huge expenses incurred by Kenyans in seeking treatment.

According to Malala, all Kenyans want is a vibrant economy that will provide an enabling environment for businesses to thrive. He believes that redirecting funds earmarked for the BBI towards addressing the economic challenges posed by the pandemic is a necessary step towards achieving this goal.
