On June 30, 2019, the Ethics and Anti-Corruption Commission (EACC) accused Chief Justice David Maraga of blocking its investigation into the Supreme Court Registrar Esther Nyaiyaki over allegations of doctoring a report used to nullify the 2017 presidential election.
According to EACC Spokesman Yassin Amarrow, the agency had summoned Nyaiyaki over allegations of doctoring a report, which the Supreme Court used to nullify the 2017 presidential election. However, Maraga issued 'unachievable conditions' to the investigators, blocking the probe.
Senior counsel Paul Muite and former IEBC CEO Ezra Chiloba had previously claimed that the documents used by the judges were fake and not those that the IEBC had forwarded to the top court.
Chiloba denied that there was hacking of the IEBC servers as alleged by NASA lawyers in court, stating that he had reason to believe that the report presented to the court did not reflect the true picture of the state of their records.
The Supreme Court annulled the election victory of President Uhuru Kenyatta and ordered a repeat of the 2017 presidential poll, following a successful petition by NASA.
